Holmes Beach City officials could levy fines against controversial tree house

MANATEE COUNTY, Fla. (WFLA) — On Wednesday afternoon, Holmes Beach City officials held a public hearing to consider whether the controversial beach side tree house will be torn down.

Lynn Tran, the owner of the tree house said a penalty hearing was being held where officials discussed whether to impose fines of up to $250 a day until it is torn down. No decision was made Wednesday, but one is expected in the near future.

This has been an ongoing battle between the city and tree house owners that has lasted for years.

The tree house was built in 2011 but was quickly met with controversy. The city said the structure violated numerous building codes and was built without proper authorization. The city issued citations and threatened to fine the owners.

After the story broke, it made headlines around the world and was even featured on the Today Show.

Tran and her husband Richard Hazen filed a lawsuit against the city, spending over $100,000 in legal fees to protect their tree house.

Last fall, a panel of District Court judges denied an appeal filed by Tran and Hazen. This allowed the city to finally issue fines until the structure is demolished.
