MANATEE COUNTY, FL (WFLA) – If you’ve ever had a home repair you just couldn’t get fixed, then you know the frustration of some folks in the Willowbrook community in Bradenton.
For more than a year, 8 On Your Side has been showing you homes in that community with collapsing balconies, and holes in the ceilings. Residents have been moving out while the builder, KB Home, has started repairs on the buildings.
Now, KB Home has filed a lawsuit against its subcontractors. Late last week, KB Home filed the suit against 41 subcontractors, ranging from air conditioning companies to a landscaper.
KB Home says these companies were responsible for constructing the Willowbrook community, and the company is demanding a jury trial.
The court papers state: “KB HOME has been required to incur significant damages to investigate, repair and remediate the Project and to resolve claims with the individual unit owners… furthermore, the Alleged Defects have caused KB HOME to suffer special damages, including damage to KB HOME’S goodwill and business reputation.”
In a statement, KB Home said: “KB Home is actively making repairs in the Willowbrook community and continuing to resolve our homeowners’ concerns. We stand behind our homes and our warranty, and expect our trade partners, whose work goes into our homes, to do the same. KB Home’s lawsuit seeks reimbursement and pursues claims against contractors who may not have fulfilled their obligations in constructing the homes in Willowbrook.”
One resident believes KB Home is just trying to save face.
Armando Oyola-Delgado showed 8 On Your Side his balcony, or what was left of it. It’s been torn up, and is covered with a tarp and building supplies. He says a few years ago he started seeing problems.
“The balcony started collapsing, water was coming in,” said Delgado.
He said work crews did some repairs, but as of now Armando Delgado’s balcony is totally unusable.
“They left it like that, and they never came back,” Delgado said.
Inside Delgado’s home, mold damage is evident. There are even mushrooms growing in his living room.
8 On Your Side discovered a number of KB Home communities in the Tampa Bay area that have similar defects. Delgado says he’s not impressed by the lawsuit; he just wants his money back.
“Is it the subcontractor or is it KB Home that keeps making the same mistake over and over again?” said Delgado. “Are they pinching pennies? Is that what’s going on?”
Right now, Delgado doesn’t live in his condo anymore, and some other residents have moved out as well.
8 On Your Side called a few of the subcontractors listed in the suit, but they have not commented at this time.
